The DOJ, on behalf FinCEN, filed a motion to appeal and stay the injunction in the Samantha Smith BOI case. The motions filed appeal the court’s BOI ruling and request a stay on the current injunction on BOI reporting. Given recent Supreme Court decisions, we expect the injunction to be similarly lifted.

We are encouraged by FinCEN's intention to provide a 30-day filing extension for the BOI report in the event the injunction is lifted; however, we continue to urge FinCEN to consider a longer extension period to appropriately account for the lack of awareness and confusion around the filing status.

This does not change the status of the BOI reporting deadline, but we wanted to keep you apprised of the developments in the case.

The AICPA continues to maintain its advice that those assisting clients with BOI report filings gather the required information from clients and be prepared to file the BOI report if the injunction is lifted again. And as always, you can find updated information on our BOI Resource Center.
